Maybe he did murder his wife... but until a prosecutor can prove that beyond a reasonable doubt to 12 of his fellow citizens, he's innocent... let's please remember that.

Prove it. That's all I'm asking. If a prosecutor--or anyone--can prove to me that he killed his wife and unborn child, I'll be the first volunteer to push the button to start up the electric chair.
I wasn't saying you don't know the law--I respect you enough to realize that you're a smart gal. And you're right, you do have a right to your opinion.
I have a bad history with trying to have intelligent debates on message boards--normally, other people think they have to resort to name calling. So with that in mind, I'm going to stop here.

But keep in mind this is a LOCAL story for Tricia... did you not have any intense emotions against the guy that ran the Creamatoium here in GA when that all went down? Sure he was "innocent until proven guilty" but being LOCAL my emotions on that story had me crucifying that man from day one... (then again 'I' would probably do that local or not)

No, I didn't.
I always try to look at things as the guy is innocent until proven guilty, local or not.
The media puts it through our heads that there is no doubt that these guys are guilty. They make it seem as if an arrest means that there's plenty of evidence and there's no doubt.
With the creamatoium place in Georgia, it was pretty open and shut... I think the guy even confessed. In this case, I haven't seen/heard evidence to prove he killed her--hence, I look at him as being innocent.

I'm still not convinced he did it due to the lack of actual evidence, but, hell maybe he did do it and he'll confess before he gets the needle.
This whole trial has been a crock. Why did it drag out so long? Southerlyn and McCoy on Law & Order could have knocked this one out in an hour with commercials.

Oh the gas chamber, I had my time in one of those, it was only cs gas though, meant to overstimulate the senses to send you into a state where you're dripping snot and spit and feel as though you can't breathe..........yeah, I miss basic training, where else do you get gassed and then the next day think "Hey, that was pretty cool!"

There is going to be a sentencing/penalty phase that will start in a few weeks (Nov 22nd should last 4 days). More testimony, etc. The judge does not have a say.
I am pretty sure that the jury decides, I might be wrong but I am pretty sure.

capital punishment has long been an issue, not all states currently have it, but those that do have it tend to still use it quite often. I think it boils down to politics, as with everything else, it's either kill the killer or finance the rest of his life in a federal penatentury...........if you were a politician, what would you do?

I don't understand the whole point of having the penalty phase with the jury when the judge can totally give him life if he wants. But if the jury would have said life, the judge could not give him death. :roll:
I guess the judge's part will go down in Feb.
Not like of the 500+ inmates on California's Death row only 11 have been executed since the 70's or anything.
I just don't get it.

He's doing a good job with the cards that he was dealt. Certainly, he's doing a far better job than Davis did. Plus, he's not afraid of offending anyone. He tells it as he sees it. Quite rare in politicians today.

he probably won't be put to death though because Cali. is too slow with their death sentences. they have about 400 people to kill before him...it's going to be a while

The overwhelming opinion by the legal community is that WITHOUT a serious mishap by his lawyer (and even then, he'd still probably get it on grounds of gross negligence of council) then the rulling will be overturned and declared a misstrial.
The judge cannot dismiss the final juror who was making it difficult to get a guilty verdict in INORDER to get the verdict in a NATIONALLY telivised, high profile, muder trial.
None of the 6 lawyers I have discussed this case with think there is a shot in hell of this verdict standing.
So while we may all get a warm fuzzy from this, there's a flag on the play. Holding, on the offense. 15 yards. replay the down.

Well, as much as I agree, and as much as you're right... that's not enough to appeal on. You can't appeal that the jury made a dumb decision.

I wasn't saying that the reasons I mention would cause the case to be thrown out on appeal. I think Andrew's reasons are gonna be what fubars this first trial. The judge was trying to get the jury to punch out a verdict asap.

A judge formally sentenced Scott Peterson to death Wednesday after family members got into a shouting match and Laci Peterson's mother sobbed as she called her son-in-law "an evil murderer."
Judge Alfred A. Delucchi allowed only Laci's family members to speak at the hearing after indicating he believed the death penalty was warranted.
Peterson's father yelled from the audience as Laci's brother, Brent Rocha, spoke to the court, saying "Laci and Conner are the true victims here."
"What a liar!" Lee Peterson said before the judge admonished him and he stormed out of the courtroom. Jackie Peterson, Scott Peterson's mother, also interrupted Rocha but her voice was inaudible.
Scott Peterson, 32, was invited to make a statement. After several minutes of discussion with his attorneys, he declined.
Delucchi denied a defense request for a new trial before upholding the jury's recommendation that Peterson be sentenced to death.
"The court is satisfied beyond a reasonable doubt that the defendant, Scott Lee Peterson, is guilty of first-degree murder" and second degree, Delucchi said, adding that he found the killings "were cruel, uncaring, heartless and callous."
Peterson, shackled at the waist and wearing a dark suit, showed no emotion throughout the hearing.
Peterson will be sent to death row at San Quentin State Prison within 48 hours, said San Mateo County Sheriff's Lt. Lisa Williams. The infamous lockup overlooks the same bay where Laci Peterson's body was discarded.
Laci's mother, Sharon Rocha, sobbed and trembled from a podium as she lashed out at her former son-in-law. Scott Peterson stared back at her without emotion.
"You decided to throw Laci and Conner away, dispose of them like they were just a piece of garbage," she said. "You were wrong; dead wrong."
Dabbing at her eyes with tissues, she called him "an evil murderer."
"The fact that you no longer wanted Laci did not give you the right to murder her," Sharon Rocha said. "She was my daughter ... I trusted you, and you betrayed me ... You betrayed everybody."
Peterson was convicted in November of first-degree murder in the killing of Laci and second-degree murder for the slaying of her fetus. A jury recommended the death penalty a month later.
Rocha spoke to Scott Peterson directly.
"I would hope that you regret the choices that you made. Maybe you don't," Rocha said. "Did you really hate Laci and Conner that much or did you just dislike yourself?"
Peterson's attorney, Mark Geragos, tried to get the judge to allow Peterson's parents, Jackie and Lee Peterson, to speak, on the basis that they were related to Conner.
But the judge said the hearing was an opportunity for Laci's relatives to speak only. He ordered Scott Peterson to pay $10,000 restitution for funeral expenses and an additional $5,000, though the reason for that amount was unexplained.
